1. Scope and Acceptance

These Terms of Service (“Terms”) govern your access to and use of the Tekno3D Labs LLC AI Generation Suite (“Platform”), a cloud-based AI image and video generation service accessible at tekno3d.com/generate/, related studio pages, Interactive Persona tools, and the Generation API.

By registering, logging in via Discord OAuth or a Hub account, purchasing credits, or otherwise using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease use of the Platform.

2. Eligibility and Age Verification

2.1 Minimum Age

The Platform is strictly for adults aged 18 years or older (or the age of majority in your jurisdiction, whichever is higher). By using the Platform you affirm under penalty of account termination that you meet this requirement.

2.2 Geographic Restrictions

You are responsible for determining whether use of the Platform is lawful in your jurisdiction. If use of the Platform or of specific models would violate the laws of the place from which you access the service, you must not use those features.

2.3 Account Responsibility

Your account is personal and non-transferable. You are solely responsible for all activity that occurs under your account.

3. Description of Service

The Platform is a cloud-hosted AI generation service. All processing is performed on third-party infrastructure. When you submit a generation request:

• Your text prompts and reference media are transmitted to third-party AI inference providers including RunPod, Alibaba Cloud DashScope (Singapore), Mulerouter, CarrotHub, KIE.AI, fal.ai, WaveSpeed, xAI, and others depending on the model selected.
• Interactive jobs run in a user-controlled session described in Section 8.1. You generate, download, and may wipe the file from our storage. If you do not wipe it, it auto-wipes within 24 hours. Reference uploads wipe on RESET SESSION — New Edit, session end, or browser refresh.
• Voice audio uploaded for voice cloning is transmitted to Alibaba. The resulting voice ID is stored in our database.
• Conversation history with Interactive Persona characters is stored in our database until you delete it.
• Generation job metadata including your prompt, model, credits used, and IP address is logged in our database.

The Platform does not operate an Identity Lock, face-swap, or stored face-profile product. Face uploads are for that job only and are not used for training.

Use of the Platform constitutes your acknowledgment of and consent to the above data flows.

4. User Accounts and Authentication

The Platform uses Discord OAuth and Hub accounts for authentication. By logging in with Discord you authorize us to receive your Discord user ID and username. We create a corresponding account and store your Discord ID, username, and credit balance in our database. We do not collect your Discord email, password, or any other Discord data beyond your user ID and display name. Hub accounts additionally store the email address you register with. Your account is personal and non-transferable.

5. Credits, Payments, and Subscriptions

5.1 Credit Packs

Credits are purchased via Stripe, Inc. Credits are non-refundable once used for generation. Each credit pack is valid for 30 days from the date of purchase. Unused credits from that pack are then removed and are not rolled forward.

5.2 Subscription Tiers

Subscription tiers (Creator, Studio Pro) provide a monthly generation allowance at zero credit cost via dedicated infrastructure. Subscriptions are billed monthly through Stripe and cancellation takes effect at the end of the current billing period.

5.3 No Refunds on Consumed Credits

Credits consumed during generation jobs are non-refundable, including jobs that produce a failed or unsatisfactory output, except where our system automatically refunds credits due to a confirmed platform-side timeout or processing failure.

5.4 Stripe Compliance

All payments are processed by Stripe, Inc. By making a purchase you agree to Stripe’s Terms of Service and Acceptable Use Policy. We reserve the right to suspend accounts flagged by Stripe for suspicious activity.

6. Content Policy and Prohibited Uses

6.1 Strictly Prohibited Content — Zero Tolerance

You may not use the Platform to generate, process, or distribute:

• Any content depicting, suggesting, or involving minors (persons under 18 years of age) in sexual, suggestive, romantic, or exploitative contexts. This applies to real, fictional, illustrated, or AI-generated characters. Zero exceptions.
• Non-consensual intimate imagery (NCII) or “revenge porn.”
• Deepfakes or synthetic media using the identifiable likeness of real persons without their explicit written consent.
• Content designed to harass, stalk, defame, or intimidate specific individuals.
• Content that violates U.S. federal law, Wyoming state law, or applicable laws of your jurisdiction.
• Content promoting violence, terrorism, or illegal activity.

Violation results in immediate permanent account termination, forfeiture of all credits, and mandatory cooperation with law enforcement where applicable.

6.2 User-generated outputs

The Platform is a general-purpose generation tool. You choose the prompts, references, and models. You are solely responsible for every output and for how you store, share, or sell it. You must ensure outputs comply with these Terms, with Stripe’s Acceptable Use Policy when you pay through Stripe, and with the laws of every jurisdiction that applies to you. All depicted subjects must be clearly adult in appearance. We may refuse, rate-limit, or terminate requests or accounts that we reasonably believe violate this section.

6.3 Interactive Persona

By using Interactive Persona tools you additionally agree that:

• Voice audio you upload is transmitted to Alibaba and the resulting voice ID is stored linked to your persona.
• All conversation history with your personas is stored in our database subject to the retention policy in Section 8.
• Personas are fictional. Conversations are processed by large language model APIs and your prompt data may be transmitted to third-party providers.

6A. Generation API

6A.1 Scope

This section applies in addition to all other Terms when you access the Platform programmatically through the Tekno3D Generation API at tekno3d.com/wp-json/tekno3d/v1/api/v1/. Your use of the API is governed by these Terms in full, including the content policy in Section 6, which applies identically to API requests and to interactive use of the Platform.

6A.2 API Keys

API keys are issued to your account through the API dashboard and are secret credentials equivalent to a password. You are solely responsible for all activity conducted with your key, including activity by your own users, employees, or contractors, and including activity following a key you failed to secure. We store only a hash of your key and cannot recover it; a lost key must be rotated. You must rotate your key immediately if you believe it has been exposed.

6A.3 Balance and Packs

API usage draws on a prepaid USD balance purchased through Stripe. Charges are applied at the time a generation request is accepted by the upstream provider. Generations that fail on the provider side are refunded automatically to your balance. Requests rejected by our moderation layer, or rejected for malformed input, are never charged. Balance is non-refundable once consumed, is not transferable between accounts, and is not redeemable for cash. Each prepaid pack is valid for 30 days from the date of purchase. Unused balance from that pack is then removed and is not rolled forward.

6A.4 Rates

Video is priced per thirty-second clip and prorated by output length. Image generation and editing are priced per request. Your applicable rates are returned by the /balance endpoint and are authoritative; published list rates are indicative and may differ from negotiated account rates. We may change rates with thirty days’ notice, which does not affect balance already purchased.

6A.5 Resale and Downstream Users

You may build the API into your own product and make it available to your own users. If you do, you accept full responsibility for those users’ conduct and content as though it were your own. You must, at minimum, prohibit in your own terms every category of content prohibited in Section 6.1, operate a mechanism for handling abuse reports and takedown requests, and cooperate with any investigation we conduct into content generated under your key. Your key may be suspended without notice if content generated under it violates Section 6.1, regardless of which of your users submitted it.

6A.6 Media You Upload

Media submitted through the /upload endpoint or referenced by URL in a generation request is stored on Cloudflare R2 in a folder scoped to your account and delivered through our content delivery network. You may delete it at any time through the /data/delete endpoint. Deletion removes the object from storage; content delivery network caches may serve a previously cached copy for a limited period afterwards. You warrant that you hold all necessary rights and consents for every image, video, and audio file you submit, including the consent of any identifiable person depicted.

The interactive session wipe in Section 8.1 does not auto-delete API media stored through /upload unless you delete it through /data/delete.

6A.7 Automated Screening

All prompts pass through our moderation layer before reaching any upstream provider. All reference images and reference videos are additionally screened by an automated age-estimation service before generation. This screening fails closed: if the service is unavailable, your request is rejected rather than permitted. Requests rejected by screening return HTTP 422, are never charged, and are logged. Repeated rejections involving prohibited content result in permanent termination of the account without refund of remaining balance.

6A.8 Rate Limits and Availability

We may apply per-account rate limits and adjust them to protect Platform stability. The API is provided without an uptime commitment or service level agreement unless separately agreed in writing. Upstream provider outages, capacity limits, and provider-side policy changes may affect availability, model selection, or feature set at any time and without notice.

6A.9 Prohibited API Conduct

In addition to Section 6.1 you may not: share, resell, or sublicense your API key itself; expose your key in client-side code; attempt to circumvent balance accounting, rate limits, or moderation screening; use the API to benchmark against or train a competing model; or misrepresent the Platform as your own infrastructure to your downstream users in a manner that obstructs abuse investigation.

7. Third-Party AI Providers

Depending on the model selected, your prompts and images may be transmitted to the following providers:

Each provider operates under its own terms of service and privacy policy. We only transmit the minimum data required to fulfill your generation request.

Note: Alibaba Cloud DashScope applies automated content moderation to requests processed through their infrastructure. Certain models on our account operate under a commercial agreement in which this moderation is disabled at the provider level and our own moderation layer applies instead. Independently of that agreement, DashScope enforces controls on inputs containing identifiable real human faces; requests may be rejected on that basis regardless of our own content policy.

8. Data Retention

8.1 Sessions — you manage the files

Interactive generations run in a private session you control.

• Generate, then download.
• Optionally wipe the file from our storage right after download.
• If you do not wipe it, the file auto-wipes within 24 hours.
• Reference uploads lock for the job, then wipe when you hit RESET SESSION — New Edit, end the session, or refresh the browser. No logout is required.
• Face uploads are for that job, not for training.

After wipe or auto-wipe, session inputs and the output file are deleted from our servers and cloud object storage. They are not saved to a gallery or long-term library on our systems. CDN caches may serve a previously cached copy for a short period after deletion.

Inputs submitted in a session and outputs produced in that session belong to you. Tekno3D Labs LLC does not claim ownership of those materials.

Job metadata (prompt, model, settings, IP) is retained up to 30 days as listed above. Media already sent to an inference or safety provider cannot be retracted from that provider.

After deletion we cannot restore the file. Session files are scoped to your account and are not listed on a public gallery.

9. Your Data Rights

Regardless of your location, you have the following rights. Contact [email protected] to exercise them. We respond within 30 days.

• Access: Request a copy of all personal data we hold about you.
• Erasure: Request deletion of your account and all associated data.
• Rectification: Request correction of inaccurate data.
• Object: Object to processing of your data beyond what is necessary to deliver the service.

10. Cookies

The Platform uses strictly necessary cookies only: WordPress authentication cookies, WooCommerce session cookies, and Discord OAuth session cookies. No advertising cookies, analytics cookies, or cross-site tracking cookies are used on Platform pages. If this changes we will implement a consent mechanism before any non-essential cookies are set.

11. Intellectual Property

Subject to these Terms and applicable law, you own the outputs you generate through the Platform, including outputs from a session under Section 8.1. Tekno3D Labs LLC makes no claim to ownership of your generated content. All Platform software, interfaces, and branding remain the intellectual property of Tekno3D Labs LLC.

12. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. TEKNO3D LABS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED. AI-GENERATED CONTENT MAY BE INACCURATE, INCONSISTENT, OR TECHNICALLY IMPERFECT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 90 DAYS PRECEDING ANY CLAIM.

13. Indemnification

You agree to indemnify and hold harmless Tekno3D Labs LLC from any claims, damages, and expenses (including attorneys’ fees) arising from your violation of these Terms, your generated content, or your violation of any third-party rights or applicable law.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA. Disputes shall be resolved in Wyoming state or federal courts. EU consumers retain rights under applicable EU consumer protection law.

15. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the “Last Updated” date above. Continued use after changes constitutes acceptance.
